Introduction
QuietOffer LLC ("QuietOffer," "we," "us," or "our") operates the website www.quietoffer.com (the "Site"), an open database and map of commercial real estate buy boxes and recorded closings that publishes information about commercial real estate buyers, their acquisition criteria, and their reported transactions, and that lets registered users submit property pitches to those buyers (together with the Site, the "Services").
This Privacy Policy explains how we collect, use, disclose, and protect personal information, and the choices you have. This Policy also applies when you engage with us in other ways, such as sales, marketing, or events. By using the Services, you agree to this Policy and our Terms of Service. If you do not agree, please do not use the Services.
1. Information We Collect
Information you provide
- Account information: name, email address, phone number (optional), company, and role.
- Verification information: your work email address and domain, and related details we use to confirm your affiliation with a firm when you claim a firm profile.
- Sign-in information: if you choose to sign in with a third-party account such as LinkedIn or Google, we receive profile information that the provider makes available to us, typically your name, email address, profile photo, and, where available, professional details such as your employer or title. We use it to create and secure your account and to help verify your identity and professional affiliation. If you sign in with a magic link, we use your email address to send it. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.
- Firm and mandate information: acquisition criteria, target markets, price ranges, visibility preferences, and statements you submit or approve on behalf of a firm.
- Pitch information: property details you submit through the Services, such as property type, location, price, size, return metrics, and any documents or links you attach (for example, an offering memorandum), together with the contact details associated with your pitch.
- Listings and confidential materials: if we offer these features, listing details and documents you upload, records of confidentiality agreements you accept, and records of your access to confidential materials. When you view or download confidential materials, we may embed identifying details, such as your name, company, and a timestamp, in the document as a watermark.
- Communications: messages you send us, including support requests.
- Billing information: if paid plans are offered, billing details and subscription records. Payments are processed by Stripe, and your payment card details are handled by Stripe under its own privacy policy (https://stripe.com/privacy). We do not store full payment card numbers.
Accuracy of information you provide. Information you provide to us, including when you verify your affiliation with a firm, must be true, complete, and accurate, and you must keep it up to date.
Information collected automatically
- Usage and device data: IP address, browser type, device identifiers, pages viewed, referring pages, general location inferred from your IP address, and timestamps.
- Cookies and similar technologies: used to keep you signed in, measure how many pages you have viewed, protect the Services, and understand usage. See Section 7.
Information from public and third-party sources We compile information about commercial real estate buyers and transactions from sources such as public records, firm websites, press releases, and other publicly available materials, using automated and manual methods. This information relates mainly to businesses, but may include names and business roles of individuals acting in a professional capacity. We take steps to limit the display of information about private individuals and non-business entities, but we do not guarantee that every record is complete, current, or accurate. See Section 6 for how to request a correction. Firms can claim their profile to update their own information.
Sensitive information. We do not seek sensitive personal information (such as health, racial or ethnic origin, religious beliefs, or government ID numbers) and ask that you not submit it. Account log-in credentials are the only information we collect that some laws treat as sensitive, and we use them only to provide and secure your account.
2. How We Use Information
We use information to:
- Provide, operate, secure, and improve the Services;
- Create and manage accounts, verify firm affiliation, and process firm profile claims;
- Display buyer mandates, firm profiles, and transaction information;
- Deliver, review, route, hold, and moderate pitches, and notify the relevant firm or recipient about them, including by contacting firms or professionals using their publicly available business contact information to let them know a pitch is waiting or to verify or update their profile;
- Apply usage limits and plan features;
- Send transactional and service messages (such as sign-in links, claim and pitch notifications, and account notices);
- Conduct internal analytics, research, and product development, and request feedback about the Services;
- Offer, display, and measure sponsored or promotional features, if and when we make them available (see below);
- Send marketing communications, which you may opt out of at any time;
- Detect, investigate, and prevent fraud, abuse, scraping, circumvention, and violations of our Terms, including by watermarking and logging access to confidential materials;
- Comply with legal obligations and enforce our rights.
Sponsored and promotional features. We may in the future offer paid features that let users, such as buyers, firms, or brokers, promote or "boost" their profiles, mandates, pitches, or other content on the Services. Sponsored content will be identified as such. If we offer these features, we may use information described in this Policy, such as your role, asset and market preferences, and activity on the Services, to decide where sponsored content appears and to measure and report its performance. We may share aggregated or de-identified performance information (for example, view and click counts) with the user who purchased the promotion. We will not give advertisers your personal information without your consent, except as described in this Policy. If we introduce advertising or analytics technologies that change how we handle personal information, we will update this Policy and, where required, provide notice or choices before they take effect.
3. How We Share Information
As of the Last Updated date above, we do not sell your personal information, and we do not share it for cross-context behavioral advertising.
We may disclose information as follows:
- Pitch recipients. When you submit a pitch, the property details and the contact information you provide are shared with the recipient firm or its authorized representatives. If a firm has not yet claimed its profile, your pitch may be held by QuietOffer and reviewed by our team, and may be delivered to the firm when we are able to reach it.
- Public display. Buyer mandates, firm profiles, and transaction information are displayed on the Services according to the visibility settings and privacy rules we apply. Information you submit as a firm representative for publication may be visible to the public or to registered users. Publicly displayed information may be viewed, copied, and shared by others, and may remain available outside the Services even after we remove it from the Site.
- Affiliates. Companies under common ownership or control with QuietOffer, who handle information consistent with this Policy.
- Service providers. Vendors that help us operate the Services, such as identity and sign-in providers, cloud hosting and data storage, email and communication tools, mapping, payment processing, analytics and performance monitoring, security and fraud prevention, and technology tools (which may include artificial intelligence and automation tools), under obligations to protect the information and use it only for our services. For more information about the categories of providers we use, contact support@quietoffer.com.
- Legal and safety. Regulators, courts, or law enforcement when we believe disclosure is required by law or necessary to protect rights, safety, or the integrity of the Services.
- Business transfers. In connection with a merger, financing, acquisition, or sale of assets, subject to appropriate confidentiality protections.
- With your direction or consent.
- Aggregated or de-identified information that does not reasonably identify you.
4. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information, including access controls and encryption in transit. No system is completely secure, and we cannot guarantee the security of information transmitted to or stored by us. You are responsible for keeping your account credentials and email accounts secure. Please notify us promptly at support@quietoffer.com if you suspect unauthorized access. If we become aware of a data breach affecting your personal information, we will notify you and regulators as required by applicable law. Transmission of information to and from the Services is at your own risk, and you should access the Services only from a secure environment.
We may monitor and audit use of the Services to detect misuse, including scraping, duplicate or fraudulent accounts, and attempts to circumvent platform rules or limits.
5. Data Retention
We keep information for as long as reasonably necessary to provide the Services, maintain records of pitches and platform activity, resolve disputes, prevent fraud and abuse, comply with legal obligations, and enforce our agreements. Retention periods vary by data type. Information may persist in backups or archives for a limited time after deletion, and information you have already sent to a pitch recipient is outside our control. When we no longer have a legitimate need for information, we will delete or anonymize it or, if that is not possible, securely store and isolate it until deletion is possible.
6. Your Rights and Choices
Subject to applicable law and verification of your identity, you may:
- Request access to, a copy of, correction of, or deletion of your personal information;
- Withdraw consent where we rely on it, without affecting processing that occurred before withdrawal;
- Request correction of information about you or your business that appears on the Services, including information we compiled from public sources;
- Opt out of marketing emails using the unsubscribe link or by contacting us (transactional messages may still be sent);
- Manage cookies through your browser settings.
Submit requests to support@quietoffer.com. We may deny or limit requests where permitted by law, for example where we must retain records or where information is already publicly available from the original source. We will not discriminate against you for exercising your rights.
How we handle requests. We will confirm receipt of your request and may ask you to verify your identity, for example by responding from the email address on your account, before acting on it. We aim to respond within 45 days, and will tell you if we need more time as permitted by law.
California and other U.S. state residents. Depending on where you live, you may have additional rights under laws such as the California Consumer Privacy Act, including the right to know, delete, correct, and opt out of the sale or sharing of personal information. As of the Last Updated date above, we do not sell or share personal information as those terms are defined under such laws. You may use an authorized agent to submit a request, and we may require proof of authorization. You may appeal a denied request by replying to our decision email with the word "Appeal." We will respond in writing with our reasons. If your appeal is denied, you may contact your state attorney general.
California "Shine the Light." California residents may request, once a year and free of charge, information about personal information disclosed to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes. To make a request, email support@quietoffer.com.
California Online Privacy Protection Act. You may visit and browse portions of the Services without creating an account or providing personal information. Our Privacy Policy is linked from every page of the Services, and we post any changes to it on this page with an updated date. You may update your personal information by contacting support@quietoffer.com.
Categories of personal information. In the past 12 months, we may have collected the following categories, as described in Section 1, and disclosed them for business purposes to the recipients described in Section 3: identifiers (name, email, IP address); professional and business information (company, role, firm affiliation); commercial information (pitches submitted, plan and billing records); internet and device activity (pages viewed, cookies, usage logs); approximate geolocation derived from IP address; inferences drawn from the above, such as market and asset-type preferences; and communications you send us. We do not sell or share these categories as defined under applicable law.
7. Cookies and Tracking Technologies
We use cookies and similar technologies to keep you signed in, secure the Services, apply access and usage limits, and measure and improve performance. You can block or delete cookies in your browser settings, but some features may not function properly. We use Google Analytics to understand how the Services are used and to improve them. Google may set cookies and collect your IP address, device and browser information, and pages visited, and processes that information under its own privacy policy. We do not use Google's advertising features. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout or by using your browser's cookie controls.
We do not respond to "Do Not Track" signals except where required by law.
8. Electronic Communications
By creating an account, you agree to receive electronic communications from us, including legal notices, account and security messages, verification and sign-in links, and notifications about pitches and claims. Marketing emails will identify us as the sender, include our mailing address, and provide a way to unsubscribe. Automated emails are sent from team@mail.quietoffer.com. Please do not use that address for support; contact support@quietoffer.com instead. You consent to doing business electronically, and agree that electronic acceptance of our terms is legally binding.
9. Third-Party Services and Links
The Services use third-party providers, such as map providers, that may receive technical information like your IP address when you load the relevant features. The Services may also link to third-party websites, and we are not responsible for their content or privacy practices. A link to a third-party site is not an endorsement, and we are not liable for any loss or damage arising from your use of third-party sites, whose practices are governed by their own policies.
10. International Users and Data Transfers
The Services are operated from the United States and intended for users in the United States. Information may be processed and stored in the United States or other countries where our providers operate. We do not knowingly offer the Services to individuals in the European Economic Area or the United Kingdom.
11. Children's Privacy
The Services are not intended for anyone under 18, and we do not knowingly collect personal information from minors. By using the Services, you represent that you are at least 18. If we learn that we have collected such information, we will deactivate the account and delete the information.
12. Changes to This Policy
We may update this Policy from time to time, including when we introduce new features such as sponsored placements or paid plans. We will post the revised version with a new "Last Updated" date and, where required by law, provide additional notice.
